TERMS AND CONDITIONS

 

This Service Agreement is made as of the date noted on your booking form between Brittain’s Princess Parties, a sole proprietorship business in the state of Illinois. 

Whereas, we have been hired by you, hereby known as the ‘client’ for the sole purpose of providing character entertainment for a specific time and event. Brittain’s Princess Parties is an entertainment agency that provides specific party entertainment. Brittain’s Princess Parties will provide character impersonation services for the designated time, date, and length set forth by Brittain’s Princess Parties and client.

Now, therefore, in consideration of the mutual covenants and conditions contained herein, the sufficiency of which is hereby acknowledged, the parties agree as follows:

Section 1: The Services

1.A. Brittain’s Princess Parties will provide character impersonation services for the time and date set forth between client and company. Brittain’s Princess Parties is not a babysitting service and is not responsible for misbehavior, boredom, or disruptions among children.

1.B. Client understands that due to unforeseen events such as scheduling conflicts, illness, and any other extenuating circumstances, we are viable to cancel at any given time. We make a conscious effort to avoid these types of circumstances. 

1.C. Brittain’s Princess Parties does not guarantee any certain amount of activities being performed at the party. Client understands that they are paying for a service that is being charged by the hour, not by the activity.  Client understands that the amount of children attending the party may alter the amount of activities, face painting, etc., that may be performed during the allotted amount of time.

1.D. Due to increased volume of traffic, inclement weather, and highway construction, your party is subject to a 30-minute leeway. In the event your performer is late, we will stay for the allotted time booked.

1.E. FOR PARITES WITH UPDGRADES: Brittain’s Princess Parties is not liable for any skin irritation or reaction to face paint/tattoos/makeup/hair gel and any other product that may be used during the time our service is provided. Parent/guardian is consenting to the use of said product when allowing a child to participate in these activities. 

Section 2: Fees

2.A. Client agrees to pay a deposit to Brittain’s Princess Parties via credit card to confirm the party date and time within 24 hours of booking. Client understands that this contract is null and void without a deposit. Gratuity may also be paid in the form of cash the day of your event. Client is responsible for all parking fees and/or toll roads, which must be paid in cash to the performer. Extended travel fees are applied to all parties and explained during your booking process.

2.B. Parties are booked based on one hour or thirty minute increments. Your performer is only allowed to stay over for an additional 30 minutes, if the schedule allows. In the event that your party runs over the agreed time limit covered by your payment, you will be charged $50 for each additional 30 minutes.

2.C. Client agrees that the final balance for their party is due three days before their scheduled party. Your performer will not enter your party/event until the final balance has been paid through PayPal/Venmo. We do not accept cash payments for your final balance under any circumstances.

2.D. A Late Booking Fee of 10% will be charged for all events booked within 14 days (2 weeks) of the event date, applied to the total event cost. This is because of the time it takes for last-minute coordination with our cast, rearrangement of schedules, and extra delivery trips getting costumes/party supplies to our performers. The late booking fee must be paid in full along with the event payment at the time of booking to secure the date. This fee is non-refundable, even if the event is later rescheduled or cancelled.

Section 3: Cancellations & Refunds

3.A. Deposits are non-refundable. If you need to cancel for some unforeseeable reason, we will work together to reschedule your party as quickly as possible. Your deposit is valid for up to 6 months after your initial event date and then it will expire. We allow up to one reschedule. If you cancel your event for a second time, your deposit is forfeit and your event will not be rescheduled again. Our time is valuable and it takes a large amount of work to coordinate with our performers. While it is very unlikely, we reserve the right to cancel any appearance due to serious or contagious illness or injury of the performer or the performer’s family. In this situation, the booking deposit will either be put towards a new available event date or refunded. 

3.B. An adult must be present in the same area as the character and children throughout the entirety of event. If our performers feel unsafe due to a guest’s behavior, the location of a venue, or for any other reason, they have the right to confront a third party to help remove them from the event immediately. Our performers are not responsible for guest’s behavior, and the performer may leave the premises in situations where they feel physically unsafe. This includes both physical and verbal situations. If your performer leaves your event because they are concerned for their safety, you will not be refunded.

Section 4: Weather Policy

To ensure the health and safety of our performers, we have a strict weather policy. Brittain’s Princess Parties will always do our best to hold an event as scheduled, but we have the right to cancel or reschedule due to unforeseen weather conditions including heat, cold, winds, rain, or snow if the client does not provide indoor accommodations. Our performers will not perform in these weather elements under any circumstances for their own safety and to preserve the quality of our wigs and costumes. They are wearing costume pieces that trap in heat - wig caps, wigs, one-piece suits, ballgowns, long sleeves, gloves, etc., or pieces that subject them to the cold without being able to layer with coats. For outdoor events, client agrees to have an indoor backup plan. If our performers feel physically ill from the weather you subjected them to, they may leave the premises with no refunds to you. Brittain’s Princess Parties will also not perform in high winds, no exceptions. If our wigs are damaged due to being subjected to winds at your event, you will be billed for damages. Spring & Summer Events: When the outside temperature exceeds 70 degrees we require a shaded spot and fans directed at the performer during her visit. When the outside temperature exceeds 80 degrees, we require that the visit takes place indoors. Fall & Winter Events: If the temperature drops below 40 degrees, we require the visit takes place indoors or in a heated tent.

In the instance of tornado warning and watches, thunderstorms, or snowstorms predicted for your event date, we have the right to cancel or reschedule. We will not compromise the health and safety of our performers travelling to you under these weather conditions.

Section 5: COVID-19

 Client acknowledges the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing. Client further acknowledges that Brittain’s Princess Parties has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19. Client acknowledges that Brittain’s Princess Parties cannot guarantee that you will not become infected with the Coronavirus/Covid-19. Client understands that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of yourself and others. Client voluntarily seeks services provided by Brittain’s Princess Parties and acknowledges that you are increasing your risk to exposure to the Coronavirus/COVID-19. Client understands that this release discharges Brittain’s Princess Parties from any liability or claim that the Client, their family, or any guests may have against the company. This liability waiver and release extends to the company together with all owners, partners, and independent contractors.

 Section 6: Miscellaneous 

 6.A. As unforeseen events occur, Brittain’s Princess Parties cannot be held responsible for sequential, punitive, or speculative damages, theft, accidents, and incidents that are beyond a person’s control. If such an incident should arise, it is our priority to fulfill the obligatory duties set within the confirmation agreement, between both parties. In the case of an unforeseen event, 1) Client must notify Brittain’s Princess Parties within 24 hours of scheduled event. 2) Both parties must agree upon a mutual solution that will benefit the circumstances. In the case of unforeseen events, Brittain’s Princess Parties’ liability exposure is limited to the amount of client fees for the service.

6.B. Corporate vendors must let us know if you will be having some other type of character entertainment at your event. This helps our performers know what to expect so they can ensure the best performance. We will not, unless otherwise agreed upon, work with any other individual or group character impersonators under any circumstances.

6.C. Invalid credit cards, NSF credit cards, and failure to pay will be handed over to the district attorney and may be charged up to 3 times the amount of the service, plus an applicable IL law late fee charged daily for late payment.

 Section 7: Privacy Statement

 Brittain’s Princess Parties is the sole owner of the information collected. We only have access to/collect information that you voluntarily give us via email or other direct contact from you.

Unless you ask us not to, we may contact you via email in the future to tell you about specials, new products or services, or changes to this privacy policy.
